On the board's request, here is the research about the Falls City Water Supreme Court decision re the unconstitutionality of charging Fairfax customers (including all of us) higher rates than city residents. The Va. Supreme Court has upheld a lower court ruling that such differential charges are illegal. The board also received a "template" of a letter that another water user has sent to Falls Church asking for a refund. The board though such a letter could be included here online as information that may be helpful to our community. This sample letter is not intended to offer legal advice but serves to provide a template. The original letter was recently sent to Falls Church by another Fairfax citizen. The letter can be changed in any way. Fairfax County government is litigating for the county, but at this time it is up to each individual to decide what he/she wants to do about these apparent overcharges.
